Photo: Depositphotos.com Two Dutch victim support groups are taking legal action against Elon Musk’s social media site X and the platform’s AI tool Grok which allows users to generate images of the sexual abuse of minors. Grok is under fire worldwide because of the software’s nudity function, and court cases are already pending in several countries. Offlimits, which specialises in the impact of online abuse, and Fonds Slachtofferhulp are now going to court in the Netherlands. The case is due to start in Amsterdam on March 12. The organisations want the court to impose a €100,000-a-day penalty for every day that Grok and X fail to remove the nudity option. Generating sexual images of minors is covered by Dutch legislation on online sexual abuse. “These AI-processed images are used to bully, humiliate and sexually intimidate victims,” said Offlimits director Robbert Hoving. “These tools have a low threshold for use and that makes it possible to produce and spread images on a large scale,” he told the AD. Police are aware of a number of Dutch victims linked to the use of the Grok software, he said. Under the European digital services act (DSA), X is considered a “major online platform” and faces additional responsibilities when it comes to spreading illegal material and protecting the fundamental rights of minors. The previous Dutch cabinet said in January it was looking into a potential ban on AI tools such as Grok. Elon Musk said in January that Grok users will no longer be able to edit photos of real people to show them in revealing clothing in jurisdictions where this is illegal. X said the tool is also behind a paywall.
