Elon Musk testified in a California courtroom, asserting he was assured by OpenAI co-founder Sam Altman that the artificial intelligence company would remain a nonprofit, despite early discussions about a for-profit model.
Musk is suing OpenAI, its co-founder Sam Altman, and President Greg Brockman, alleging they secured his $38 million in donations and assistance under the premise of a nonprofit dedicated to safe AI, only to pivot to a for-profit entity for personal gain.
During cross-examination, Musk admitted he did not read the "fine print" of a 2017 term sheet detailing OpenAI's transition to a for-profit structure, reiterating his belief that he was reassured it would stay nonprofit.
OpenAI's legal counsel countered that Musk is motivated by a desire to control the company and resentment over its success since his 2018 departure from its board, also noting his own AI venture, xAI, uses OpenAI models.
Musk is seeking $150 billion in damages and demands OpenAI revert to its nonprofit status, with proceeds intended for its charitable arm, while the judge rejected testimony on AI safety risks, noting Musk's own AI venture.
